Cannabis “Schedule III” Rescheduling: What Florida Patients Need to Know

Federal agencies are moving toward reclassifying cannabis from Schedule I to Schedule III—but it is not finalized yet. Here’s what’s confirmed, what’s still in process, and what Florida patients should do right now.

What’s happening right now

  • In May 2024, the U.S. Department of Justice/DEA issued a proposed rule to move marijuana from Schedule I to Schedule III.
  • On December 18, 2025, the White House issued an Executive Order directing DOJ/DEA to expedite completion of the rescheduling process.
  • Important: This does not mean rescheduling is already finished. Final action is still pending under federal rulemaking procedures.

What Schedule III would mean (once finalized)

Schedule III substances are recognized as having accepted medical use and a lower abuse potential than Schedule I drugs. If finalized, this would be a major federal shift in how marijuana is classified—and could reduce barriers to medical research.


What does NOT change for Florida patients today

Florida’s medical marijuana program remains state-regulated, and rescheduling does not automatically rewrite Florida rules.

Right now:

  • You still need an active Florida medical card to purchase.
  • Dispensary access, product availability, and purchase limits are still set by Florida law.
  • This is not recreational legalization.

What Schedule III does NOT mean

Even if Schedule III becomes final later, it still does not mean:

  • Cannabis becomes “federally legal” like alcohol.
  • You can legally travel across state lines with cannabis.
  • Employer drug-free workplace policies must change automatically.
